Data Processing Information (GDPR)

The controller of personal data of customers and their personnel is Kanlux S.A. with its registered office in Radzionków (41-922) at ul. Objazdowa 1-3. More information about the manner and purposes of data processing and your rights can be found below.

Fulfilling the information obligation contained in Art. 13 and 14 of the General Data Protection Regulation (GDPR), we inform you that:
  1. The controller of personal data of customers and their personnel is Kanlux S.A. with its registered office in Radzionków (41-922) at ul. Objazdowa 1-3 ("Controller").
  2. The Controller can be contacted at the registered office address or by e-mail: ado@kanlux.pl.
  3. Personal data is processed for the purpose of:
    • conclusion and performance of the contract, including creating and maintaining a customer account in the B2B store (pursuant to Art. 6(1)(b) GDPR),
    • keeping the Controller's accounting records in order to fulfil the legal obligation arising from generally applicable laws, in particular tax and accounting legislation (pursuant to Art. 6(1)(c) GDPR),
    • organising work, business contacts, document circulation, maintaining correspondence records and a register of contracts, which constitutes the Controller's legitimate interest in processing data (pursuant to Art. 6(1)(f) GDPR),
    • pursuing and defending claims and for archival purposes, which constitutes the Controller's legitimate interest in processing data (pursuant to Art. 6(1)(f) GDPR),
    • conducting direct marketing of own products or services, which constitutes the Controller's legitimate interest in processing data (pursuant to Art. 6(1)(f) GDPR), in particular where consent has been given for marketing communications or sending commercial information by electronic means.
  4. Providing data related to the performance of the contract is voluntary but necessary for its performance. Providing data for marketing purposes is voluntary.
  5. Customer personnel data (first name, last name, e-mail address, phone number) is provided by the employer for the purpose of performing contracts concluded with the Controller, in particular to create an account for an employee to manage the customer account.
  6. Personal data will be stored for the duration of the contract and, after its termination, for the period required to fulfil accounting or tax obligations (for the duration thereof) and the limitation period for all claims arising from the contract; where consent has been given for the processing of personal data for marketing purposes, until that purpose is achieved or consent is withdrawn.
  7. Personal data will be stored in an IT environment, which means that in order to ensure the security and proper functioning of IT systems, data may also be temporarily stored and processed, e.g. in backup copies, as part of IT system tests or procedures aimed at detecting irregularities or protection against abuse or attacks.
  8. Recipients of the data may include:
    • the Controller's personnel,
    • subsidiaries and affiliates of Kanlux S.A. and its permanent commercial representatives with registered offices in a European Union Member State,
    • entities supporting the Controller on its instructions in the field of IT services and technical support, transport services, printing services, document archiving and destruction services, postal services, banking, financial and insurance services, advisory, legal and debt collection services,
    • other controllers who need access to the data to perform their duties.
  9. No automated decisions, including profiling, will be made based on your personal data.
  10. You have the right to:
    • access your data;
    • rectify your data;
    • request the erasure of your data;
    • restrict the processing of your data;
    • object to the processing of your personal data;
    • data portability;
    • where the processing of personal data is based on the Controller's legitimate interest, to object at any time to the processing of personal data on grounds relating to your particular situation,
    • lodge a complaint with the supervisory authority if you consider that the processing of personal data violates applicable law.
